Demand Immediate Investigation and Impeachment for DHS Surveillance of Protesters

To: Sen. Husted, Sen. Moreno, Rep. Joyce

From: A constituent in Willoughby, OH

February 17

I am writing to demand immediate action regarding the Department of Homeland Security's unconstitutional surveillance of American citizens exercising their First Amendment rights to protest and criticize Immigration and Customs Enforcement. This represents a constitutional crisis requiring urgent intervention through impeachment proceedings under Article II, Section 4 against those responsible, including the President, Secretary Kristi Noem, Tom Homan, and Stephen Miller. The evidence is alarming and well-documented. Despite ICE acting director Todd Lyons testifying under oath that "We do not do that" when asked about maintaining databases on protesters, The New York Times reported that DHS has issued hundreds of administrative subpoenas to Google, Reddit, Discord, and Meta in recent months demanding identifying information about social media accounts that track or criticize ICE. These companies have already complied with some requests, turning over names, email addresses, telephone numbers, and other personal data of American citizens engaged in lawful speech. The intimidation extends beyond digital surveillance. Nearly 100 sworn statements filed in Minnesota federal court describe federal immigration agents appearing at protesters' homes. One Minnesota woman who attended local protests was approached by an unknown ICE agent who called her by name, then had her Global Entry and TSA travel privileges revoked without explanation. In Pennsylvania, a man who sent a nonthreatening email to DHS prosecutor Joseph Dernbach asking for mercy for an Afghan asylum seeker had his Google account subpoenaed within hours, followed by badge-wearing men knocking on his door that same day. These actions violate both the First Amendment right to free speech and peaceful assembly, and the Fourth Amendment protection against unreasonable searches and seizures. This is the behavior of authoritarian dictatorships, not democratic republics. When government officials use the surveillance apparatus to intimidate citizens for lawful dissent, they commit high crimes and misdemeanors warranting removal from office. I urge you to immediately initiate impeachment proceedings, launch congressional investigations with subpoena power, and halt all DHS surveillance activities targeting protesters and critics. Our constitutional system depends on your swift action to defend fundamental rights against this authoritarian overreach.
