Demand Impeachment for Unconstitutional Surveillance of Immigrants and ICE Critics

I am writing to demand immediate action against the Trump administration's expansion of social media surveillance targeting immigrants and anyone critical of Immigration and Customs Enforcement, which constitutes a grave violation of constitutional rights and represents an authoritarian overreach that threatens the foundations of our democracy. The Department of Homeland Security and Immigration and Customs Enforcement are now monitoring social media accounts of immigrants, travelers, and critics of ICE using artificial intelligence software at nearly every stage of the immigration process. This surveillance extends to H-1B applicants and their dependents, students, exchange visitors, and all visa applicants, who are being instructed to change their privacy settings to "public" under federal directives. The Continuous Immigration Vetting system monitors individuals long after they arrive in the U.S., flagging content the government deems concerning, including criticism of ICE policies and practices. This program violates both the First and Fourth Amendments while raising serious privacy concerns. According to the Brennan Center for Justice, social media monitoring violates the First Amendment when it disrupts free speech without a legitimate government objective. The cases of Ya'akub Vijandre, a DACA recipient detained for social media posts about political prisoners and his reporting on pro-Palestinian protests, and a Harvard international student deported to Lebanon after officers confronted him about political posts his friends made, demonstrate how this surveillance chills protected speech and punishes political expression. The administration is flagging posts critical of the United States and its policies, political opinions about ICE operations, protests, community organizing, and immigration rights advocacy. Attorney Tracie Lynn Morgan confirms that while these activities are protected under free speech, they now draw attention from enforcement agencies. Electronic Frontier Foundation staff attorney Lisa Femia warns that anything immigrants share on social media could be monitored and used against them. This surveillance apparatus mirrors tactics used in authoritarian dictatorships and must be stopped. This is what happens in authoritarian dictatorships, and it represents what I believe are high crimes and misdemeanors under Article II, Section 4 of the Constitution. I urge you to support impeachment proceedings against President Trump, Secretary Kristi Noem, Tom Homan, and Stephen Miller for these constitutional violations. This is a constitutional crisis that demands immediate congressional action to protect our fundamental rights and democratic principles.
