Urgent Investigation into Presidential Market Manipulation and Abuse of Power

I am formally requesting that Congress immediately investigate President Donald J. Trump’s recent social media post regarding Tesla and Elon Musk, in which he stated: “Elon Musk is ‘putting it on the line’ in order to help our Nation, and he is doing a FANTASTIC JOB! But the Radical Left Lunatics, as they often do, are trying to illegally and collusively boycott Tesla, one of the World’s great automakers, and Elon’s ‘baby,’ in order to attack and do harm to Elon, and everything he stands for. They tried to do it to me at the 2024 Presidential Ballot Box, but how did that work out? In any event, I’m going to buy a brand new Tesla tomorrow morning as a show of confidence and support for Elon Musk, a truly great American.” This statement raises serious legal and ethical concerns, particularly in areas where presidential immunity does not apply: 1. Market Manipulation & Securities Law Violations • SEC regulations prohibit market manipulation that artificially influences stock prices. • Publicly endorsing a private company while falsely claiming an “illegal” boycott could mislead investors and affect Tesla’s stock value. • Presidential immunity does not extend to private business dealings or financial market interference. 2. False Claims of an “Illegal Boycott” • Boycotts are legally protected under the First Amendment, and a president cannot declare them illegal without legal grounds. • Encouraging retaliation against those exercising their constitutional rights could be government coercion, which is not protected by presidential immunity. 3. Election Law Violations (Quid Pro Quo & Undisclosed Contributions) • If Musk or Tesla later provide campaign benefits—such as algorithmic changes on X/Twitter or financial support—it could be an undisclosed in-kind contribution, violating campaign finance laws. • Presidential immunity does not cover personal campaign finance violations. 4. Abuse of Power & Retaliation Against Critics • Trump claims his political opponents are “illegally colluding” against Musk. If his administration uses federal power to punish Tesla’s critics, this could be retaliatory government action, violating constitutional rights. • Presidential immunity does not protect acts that target political opponents in a non-governmental capacity. Congressional Inquiry Is Necessary Trump appears to be using his influence to benefit a private company while attacking critics under false legal pretenses. Congress must investigate whether: 1. Trump’s statements violated SEC regulations on market manipulation. 2. His claim of an “illegal boycott” is a coercive and false statement. 3. Any financial benefit, campaign support, or regulatory favoritism has been promised to Musk or Tesla in exchange for support. The presidency should serve the American people, not private interests. I urge you to take immediate action to ensure accountability and transparency.
