I am writing to express my deep concern regarding the Department of Government Efficiency (DOGE) and the unchecked power it has been granted under the current administration. Recent reports highlight multiple constitutional violations in the agency’s operation, raising serious legal and ethical questions that Congress must address immediately.
1. Appointments Clause Violation
DOGE is currently being led by Elon Musk, despite his appointment lacking Senate confirmation. Under Article II, Section 2 of the U.S. Constitution, principal officers of the United States must be appointed with the advice and consent of the Senate. Musk’s unilateral authority over federal operations, without congressional oversight, sets a dangerous precedent and undermines the system of checks and balances.
2. Executive Overreach and Unlawful Authority
DOGE has taken sweeping actions, including ordering the termination of federal employees and gaining unauthorized access to federal databases. These decisions circumvent legislative authority and threaten the integrity of federal agencies. The Constitution does not grant the Executive Branch unilateral power to restructure or dismantle government institutions without congressional approval.
3. First Amendment Violations
DOGE’s directives, particularly regarding the elimination of Diversity, Equity, and Inclusion (DEI) programs, raise serious constitutional concerns. Threatening to withhold federal funding from states unless they comply with ideological directives violates the First Amendment’s protections on free speech and equal protection. The government should not dictate state-level policies through financial coercion.
Given these constitutional violations, I urge Congress to:
• Launch an immediate investigation into DOGE’s authority and operations to determine the extent of its overreach.
• Hold hearings on the constitutionality of Musk’s appointment and whether it violates the Appointments Clause.
• Introduce legislation to rein in DOGE’s power and ensure that all federal agencies operate within the bounds of the Constitution.
• Defend the First Amendment and protect federal employees and state institutions from coercive and unconstitutional directives.
The creation of an agency cannot supersede the Constitution, nor can it be used as a mechanism for executive overreach. I urge you to take decisive action to uphold the rule of law and preserve the integrity of our democratic institutions.
