I am writing to express concern over the proposed 10-year federal moratorium on state-level artificial intelligence (AI) regulation included in the 2025 budget reconciliation bill. This provision would prevent states from enacting laws to govern AI and automated decision-making systems, effectively halting over 500 state-level legislative efforts aimed at addressing AI-related issues such as bias, discrimination, and data privacy.
Experts warn that this moratorium could severely disadvantage consumers, innovators, and small businesses interested in ethical and fair AI design and deployment. Without the ability to regulate AI, states would be unable to protect their residents from potential harms associated with unregulated AI systems, including algorithmic discrimination and privacy violations (Brookings Institution, May 14, 2025).
Cybersecurity professionals also caution that restricting states from enacting AI laws hampers their ability to respond to rapid technological changes and growing AI-related threats, such as data leaks and algorithmic discrimination. With little progress on comprehensive federal AI laws, states like California, Colorado, and Utah have enacted or planned legislation to address these concerns. Experts argue that state regulations are critical for managing sensitive information and protecting citizens, and fear that blocking these laws without a robust federal alternative could leave dangerous gaps (Wall Street Journal, May 14, 2025).
I urge you to reconsider this provision and allow states to continue their efforts in regulating AI to ensure the protection of their residents and the ethical deployment of AI technologies.
