Today I take pen in hand to write and urge you to uphold the Presidential Records Act.
The Trump administration's claim that it is no longer bound by the Presidential Records Act threatens our ability to hold government accountable. I need you to publicly oppose this position and support legislation that reinforces the PRA's mandatory requirements.
The Executive Branch does not decide which laws to ignore. Voluntary preservation benefits no one except this lawless Executive Branch and feckless Department of Justice.
The Office of Legal Counsel opinion telling President Trump he doesn't have to comply with the Watergate-era law creates a dangerous precedent.
While the Justice Department now says White House staff are still following preservation mandates, the April 2 memo from White House Counsel David Warrington carved out troubling exceptions.
It allows staff to delete text messages containing "personal conversations, workplace gossip, ministerial tasks or other workplace minutiae" and says nothing about what steps Trump or Vice President JD Vance must take to preserve their own records.
This matters because Trump already took classified documents to Mar-a-Lago after his first term, leading to criminal charges for mishandling sensitive materials. Without clear preservation requirements covering all communication platforms including encrypted apps like Signal and WhatsApp, critical records of government decision-making could vanish.
The Presidential Records Act exists to prevent another Watergate.
Congress must act NOW to close these loopholes and ensure no president can simply opt out of transparency requirements. Thank you.
