I urge you to oppose SB1013 when it comes before the Senate Regulatory Affairs and Government Efficiency Committee on Wednesday. This legislation, sponsored by Senator Janae Shamp, is a reintroduction of a bill that was vetoed last year and would severely restrict how Arizona public schools recruit and hire educators. SB1013 would prohibit schools from implementing hiring policies based on any factors other than narrowly defined "merit." While merit sounds reasonable in theory, this bill is designed to dismantle programs that help schools build diverse teaching staffs that reflect the students they serve. Research consistently shows that students benefit academically and socially when they see themselves represented among their teachers, yet Arizona already faces significant challenges recruiting educators of color. The bill's private right of action provision is particularly troubling. By allowing anyone to file lawsuits against school districts over hiring decisions, SB1013 would open the floodgates to frivolous litigation claiming reverse discrimination. School districts would face costly legal battles even when their hiring practices are entirely lawful and appropriate. These resources should go toward classroom instruction and student support, not defending against baseless lawsuits from individuals with no direct stake in hiring outcomes. Arizona schools are already struggling with teacher shortages and budget constraints. SB1013 would make it harder to recruit qualified educators while draining limited funds through litigation. Districts need flexibility to address their specific community needs and student demographics, not one-size-fits-all mandates that tie their hands. This bill solves no actual problem facing Arizona schools. Instead, it creates new legal liability and restricts local control over hiring decisions that should remain with school administrators who understand their communities. The previous version was vetoed for good reason, and this reintroduction deserves the same fate. I ask you to vote no on SB1013 in committee and prevent this harmful legislation from advancing.
