Oppose HB 324: Protect Access to Essential Medications

I am writing to express my strong opposition to House Bill 324, the so-called "Patient Protection Act," introduced by Representatives Adam Mathews and Meredith Craig. This misguided legislation, while purporting to protect patients, will in fact endanger the lives of countless Ohioans by severely restricting access to essential medications, particularly those for mental health and reproductive care.
The bill's arbitrary 5% threshold for "severe adverse effects" is dangerously broad and fails to account for the nuanced risk-benefit analysis that healthcare providers must make when prescribing medications. Many life-saving drugs, including those for cancer treatment, mental health conditions, and reproductive health, can have serious side effects but are absolutely necessary for patient well-being. By requiring additional burdensome steps before these medications can be prescribed, HB 324 will create unnecessary barriers to care, potentially leading to treatment delays, increased healthcare costs, and poorer health outcomes.
Furthermore, the requirement for in-person examinations before prescribing certain medications will disproportionately affect rural and low-income Ohioans who may struggle to access healthcare facilities. This could exacerbate existing health disparities and lead to increased rates of untreated mental health conditions and unintended pregnancies.
The Ohio Department of Health, in collaboration with other state agencies, is ill-equipped to maintain an accurate and timely list of medications meeting the bill's criteria. This task requires extensive medical expertise and constant updates based on emerging research, which these agencies may not have the resources or capacity to manage effectively.
I urge you to oppose HB 324 and instead focus on policies that genuinely protect patients by improving healthcare access, affordability, and quality. We need legislation that trusts the judgment of medical professionals and respects the doctor-patient relationship, not bureaucratic obstacles that endanger lives under the guise of protection.
Please vote against this dangerous bill when it comes before the House. The health and lives of your constituents depend on your decision to prioritize evidence-based healthcare policies over misguided and potentially harmful legislation.
