Congress Must Ensure No Federal Agency Ignores Court Orders

CONGRESS MUST STOP DHS FROM DETAINING PEOPLE AFTER FEDERAL COURTS ORDERED THEIR RELEASE As a constituent, I urge you to speak out about credible reporting that Department of Homeland Security officials continued detaining individuals after federal courts ordered their release during recent immigration enforcement operations. A Washington Post investigative report titled “Immigration Detention Push in Minneapolis Clashes With Federal Court Orders,” published March 10, 2026, describes cases in which individuals were held even after judges ordered their release. When a federal agency continues detaining people after courts have ordered their release, the issue is not simply immigration enforcement - it is a challenge to the authority of the federal judiciary and to the rule of law itself. FEDERAL JUDGES FOUND MULTIPLE CASES WHERE RELEASE ORDERS WERE IGNORED According to the Washington Post investigation, immigration enforcement actions connected to the Minneapolis “Operation Metro Surge” led to the detention of thousands of people. Those detained reportedly included individuals with lawful status or pending immigration claims. Federal judges determined that release orders were ignored in numerous cases. Some detainees were transferred to distant detention facilities even after courts ordered their release. These transfers made compliance with judicial rulings more difficult and limited detainees’ access to legal counsel. THOUSANDS OF COURT RULINGS SHOW DHS HAS REPEATEDLY DETAINED PEOPLE UNLAWFULLY This problem extends beyond a single enforcement operation. A 2026 Reuters investigation titled “Courts Have Ruled 4,400 Times That ICE Jailed People Illegally. It Hasn’t Stopped,” published February 14, 2026, documented more than 4,400 federal court rulings in which judges determined that immigration authorities detained individuals unlawfully. Repeated judicial findings of unlawful detention raise serious concerns about whether DHS is complying with federal court orders. CONGRESS MUST INVESTIGATE DHS AND HOLD OFFICIALS ACCOUNTABLE Congress has both the authority and the responsibility to respond. I urge you to support oversight hearings investigating DHS violations of federal court orders through the relevant Congressional committees with jurisdiction over DHS and immigration enforcement. Congress should also require formal reporting whenever federal courts determine unlawful detention has occurred. Legislation should be considered establishing civil penalties and potential criminal liability for federal personnel who knowingly violate court orders. NO FEDERAL AGENCY CAN OPERATE ABOVE THE AUTHORITY OF THE COURTS Under the Constitution, executive agencies must obey the lawful orders of the judiciary. When those orders are ignored, the separation of powers that protects individual liberty is weakened. Congress must reaffirm that DHS - like every federal agency - must fully comply with federal court rulings. Thank you.
