An open letter to the U.S. Congress

Oppose Take It Down Act's threat to free expression

The Take It Down Act is a misguided attempt to address non-consensual intimate imagery online that will have severe unintended consequences for free expression and internet freedom. Donald Trump has openly bragged about how he plans to abuse its provisions to censor content he personally dislikes. Even the Cyber Civil Rights Initiative, whose entire existence is based on representing the interests of victims of NCII and passing bills similar to the Take It Down Act, has come out opposing this bill due to its many inherent problems. While well-intentioned, the vague duty of care requirements, lack of safeguards against abuse, and harsh criminal penalties make this law ripe for exploitation as a censorship tool. As digital rights groups have warned, the bill endangers vulnerable communities and enables bad faith actors to suppress lawful speech through spurious reports.
