Opposition to House Bill 249 – Protect Free Expression and LGBTQ+ Safety

I am writing to express my strong opposition to House Bill 249. This proposed legislation raises serious constitutional and human rights concerns, particularly regarding freedom of expression and the safety of transgender and queer individuals in Ohio. At its core, HB 249 appears to criminalize aspects of transgender identity and expression in public spaces. Such a measure is a direct infringement on the fundamental right to free expression, a right that should be protected for all individuals regardless of gender identity. Laws that target how people present themselves or exist in public set a dangerous precedent and undermine the principles of liberty and equality. Beyond constitutional concerns, this bill risks causing real harm. By effectively singling out transgender individuals, it contributes to stigma, marginalization, and fear. Policies like this can embolden discrimination and harassment, placing already vulnerable communities at greater risk of violence and exclusion. It is also important to ground this conversation in facts rather than fear. Public narratives often attempt to portray LGBTQ+ individuals, particularly drag performers and transgender people, as threats to children. However, available evidence does not support this framing. Instances of child abuse have been far more commonly associated with trusted authority figures across various institutions, including some religious organizations, than with drag performers. Policies should be based on evidence and aimed at protecting children without unfairly targeting or scapegoating marginalized communities. Ohio should be a place where all residents can live openly and safely without fear of punishment for who they are. I urge you to reject House Bill 249 and instead support policies that uphold civil liberties, protect marginalized communities, and foster dignity and inclusion for all Ohioans.
