I urge you to oppose SB1177 when it comes before the Senate Health & Human Services Committee on Wednesday. This legislation, sponsored by Senator Wendy Rogers, would criminalize the use of public monies for gender transition medical care, making intentional violations a class 4 felony under Section 35-301. Arizona faces genuine crises that demand legislative attention. Our state ranks 48th in teacher pay, our infrastructure needs billions in repairs, and rural communities lack adequate healthcare access. Instead of addressing these pressing issues, SB1177 targets a small, vulnerable population and criminalizes healthcare decisions that should remain between patients and their doctors. The bill's sweeping prohibition would prevent public employees with state health insurance from accessing medically necessary care. It would bar Arizona Health Care Cost Containment System coverage for evidence-based treatments, forcing families to choose between their jobs and their healthcare. Medical procedures for gender transition are recognized as medically necessary by the American Medical Association, the American Academy of Pediatrics, and every major medical organization. These treatments have decades of research supporting their safety and effectiveness. Making violations a class 4 felony is particularly extreme. Public employees who process routine insurance claims could face criminal prosecution for doing their jobs. This creates a chilling effect that extends far beyond the stated intent, potentially disrupting healthcare administration across state agencies. The fiscal impact also deserves scrutiny. Defending this law against inevitable legal challenges will cost taxpayers millions in legal fees, money that could fund actual healthcare services or address real budget priorities. Similar laws in other states have resulted in costly litigation without improving anyone's wellbeing. I ask you to vote no on SB1177 and instead focus legislative efforts on the substantive challenges facing Arizona families: education funding, healthcare access, infrastructure investment, and economic development. Healthcare decisions belong with patients, families, and medical professionals, not in the criminal code.
