Urgent: Codify Marriage Equality in Michigan State Law

The recent petition to the U.S. Supreme Court challenging the landmark Obergefell v. Hodges decision has raised serious concerns about the future of marriage equality in our state. As your constituent, I urge you to take immediate action to codify same-sex marriage rights into Michigan state law.
This challenge, brought by former Kentucky county clerk Kim Davis, marks the first time since 2015 that the Supreme Court has been asked to overturn Obergefell. While legal experts consider her bid unlikely to succeed, it is part of a broader, concerning trend. At least nine states have already introduced legislation or passed resolutions aimed at blocking or overturning same-sex marriage rights by 2025.
The Supreme Court's current conservative majority, which includes three Trump appointees, has heightened anxieties among LGBTQ advocates. Although the 2022 Respect for Marriage Act offers some protection, it does not guarantee the right to same-sex marriage if Obergefell is overturned. This leaves a dangerous gap in protections for Michigan families.
Public support for same-sex marriage has plateaued since 2020, with Republican support notably declining. This shifting landscape makes state-level protections more crucial than ever. By codifying marriage equality into Michigan law, we can ensure that all our citizens' rights are protected, regardless of potential federal changes.
The Supreme Court is expected to consider Davis' petition this fall, with potential oral arguments in spring 2026 if accepted. This timeline gives us a narrow window to act. I implore you to introduce or support legislation that will enshrine marriage equality in our state statutes. This action would provide certainty and security for thousands of Michigan families and reaffirm our state's commitment to equality and justice for all.
