An open letter to the President & U.S. Congress

Protect Judicial Authority from Trump’s Overreach

I am writing to demand immediate congressional action to prevent Donald Trump and Elon Musk from continuing their blatant disregard for the separation of powers and the authority of the judiciary. Their recent violation of a federal court order halting funding cuts is not just an overreach—it is a direct attack on the rule of law and the constitutional structure of our government. The United States operates under three coequal branches of government: the executive, legislative, and judicial. The judiciary’s role is to interpret and enforce the law, yet Trump and Musk are acting as though court rulings do not apply to them. A federal judge has already ruled that their administration violated a standing court order by continuing to cut off funding that the judiciary had explicitly protected. This is not a policy disagreement—it is a flagrant violation of a court order, setting a dangerous precedent that the executive branch can ignore judicial rulings with impunity. This is not the first time Trump has attempted to override the judiciary. His administration has a documented history of defying court orders, including past rulings on immigration bans, asylum policies, and environmental regulations. His repeated attempts to circumvent the courts and consolidate power are not just undemocratic—they are unconstitutional. If left unchecked, this will undermine the ability of the judiciary to serve as a check on executive overreach, weakening the foundation of American democracy. Elon Musk’s influence in government decision-making is equally troubling. He is not an elected official, yet he is now wielding power over critical policy decisions that should be debated and enacted through proper legislative channels. His unchecked role in these decisions further erodes accountability, allowing Trump to push through extreme measures without due process. Congress cannot allow the executive branch to ignore judicial authority. If a president can simply override court decisions they don’t like, then we no longer live in a constitutional democracy—we live under authoritarian rule. I urge you to take the following immediate actions: 1. Publicly condemn the administration’s violation of the court order and demand full compliance with the judiciary’s ruling. 2. Introduce or support legislation that strengthens enforcement mechanisms against executive overreach and prevents unilateral funding cuts without congressional approval. 3. Hold oversight hearings to investigate the administration’s continued defiance of legal rulings and its reliance on unelected billionaires like Musk to dictate policy. 4. If Trump continues to ignore court orders, Congress must consider impeachment proceedings. The time to act is now. If Congress allows this lawlessness to continue, it will set a precedent that future administrations can exploit. The balance of power in our government depends on strong congressional oversight and a commitment to defending the Constitution.
