What’s Really Happening Trump’s executive order would make it nearly impossible to challenge policies that disproportionately harm minorities unless there’s explicit proof of racist intent. In reality, most discrimination today is not overt; it’s embedded in policies and practices that may appear neutral but have deeply unequal effects. By eliminating disparate impact liability, Trump is giving cover to companies, schools, and agencies to discriminate as long as they don’t openly admit it. This is a deliberate attempt to turn back the clock on civil rights, echoing the tactics of Jim Crow—racism repackaged for the modern era. The Supreme Court’s Role The Supreme Court has already made it easier for Trump to pursue this agenda. By stripping federal agencies of their authority to interpret and enforce civil rights laws, the Court has shifted power to judges who may lack the expertise or commitment to civil rights.
