Reassert Congressional authority over tariffs and trade policy

The president lacks legal authority to unilaterally impose broad tariffs on U.S. trading partners. The Constitution grants Congress the power to regulate foreign commerce and set tariffs. While Congress has delegated some limited tariff authorities to the president for specific circumstances like national security threats, those powers were not intended to be used as the president proposes. Broad tariffs would significantly disrupt supply chains, raise costs for businesses and consumers, damage relationships with allies, and undermine U.S. economic and strategic interests. The national emergency claims are mere pretexts to bypass Congress's constitutional role. We urge Congress to reassert its authority over tariffs and trade policy. The system of checks and balances is being circumvented. Unilateral executive tariff actions destabilize the rules-based trading system and hurt American competitiveness. Responsible oversight is needed to prevent abuse of limited statutory exceptions. Restoring the proper balance of powers will promote economic growth, preserve U.S. leadership, and strengthen democratic norms.
