Pleading the 5th Is Not Contempt: Say NO to the Fauci Resolution

As your constituent, I am writing ahead of Thursday's 8:30 AM Senate Homeland Security and Governmental Affairs Committee markup to demand that every member of Congress, whether or not you sit on this committee, publicly oppose holding Dr. Anthony Fauci in contempt of Congress. The July 29 proceeding was not a legitimate fact-finding inquiry. It was a predetermined political show trial. Threatening a subpoenaed witness with contempt for exercising a core constitutional right sets a dangerous precedent that undermines the Constitution and degrades the institutional integrity of the Senate: - Asserting the Fifth Amendment Protects Against a Bad-Faith Perjury Trap: Committee Chairman Rand Paul has repeatedly declared, for years, that Dr. Fauci "should go to prison" and "without question" belongs in jail, based on an interpretation of NIH funding records that independent fact-checkers have repeatedly found does not support his claim that Fauci lied under oath. In an environment where the committee's own chairman has spent years publicly campaigning for a witness's prosecution on a debunked basis, invoking the Fifth Amendment on advice of counsel is not evasion. It is a necessary constitutional shield against a bad-faith, weaponized prosecution. Chairman Paul's public prejudgment makes Dr. Fauci's invocation legally justified, not suspect. A prior presidential pardon does not eliminate Fifth Amendment protections against potential new perjury charges for any misstatements given under oath today. - Weaponizing Contempt Subverts Procedural Due Process: The physical removal of defense counsel from the hearing room and the subsequent threat of criminal contempt penalize a witness for refusing to walk into a legal trap that the committee's own chairman has spent years publicly building. Using congressional contempt powers to punish a witness for asserting constitutional rights abuses the oversight mandate. - Constituents Are Tracking Committee Integrity: Congressional oversight exists to inform legislation and ensure executive transparency, not to serve as a platform for a years-long personal vendetta or a cable news moment. Citizens across the nation are watching how our elected officials handle this Thursday morning. I urge you to uphold the rule of law, protect basic constitutional guarantees, and make clear, whether through your committee vote or your public voice, that you reject weaponized prosecutions and oppose any contempt resolution against Dr. Anthony Fauci.
