Pass federal legislation banning the gay and trans panic defense nationwide. Right now, in most of this country, a person can kill someone, claim they were provoked by their victim's sexual orientation or gender identity, and walk away with a reduced sentence or acquittal. That is not a loophole. That is the law telling certain people their lives are worth less.
Cases like the overturned conviction of Samuel Ward — who shot Paris Lee six times, fled the scene, waited 30 minutes to call 911, and was uninjured — show exactly what this gap produces. Physical evidence contradicted his self-defense claim at every turn, a jury convicted him, and an appellate court still handed him a second chance by treating Lee's identity as legally relevant to her own murder. Only 20 states have banned this defense. That means in 30 states, a victim's identity can still be used as justification for killing them.
This is not a state-by-state issue. A trans woman's life should not depend on which side of a state line she lives on. Black trans women are already among the most targeted people in this country for violence. Every day this defense remains legal anywhere in the United States is a day the government signals it does not see them as fully human. End it federally, now.
