ICE agents fatally shot a 37 year-old woman during an enforcement operation Wednesday morning.
According to reporting by The Washington Post, the woman was a U.S. citizen, was not the subject of any legal investigation, and was acting as a legal observer.
DHS falsely claimed the shooting was “self defense,” alleging that the “rioters” were attacking ICE officers, and that the woman tried to run them over with her car. Spokeswoman Tricia McLaughlin called it an “act of domestic terrorism.”
Trump tried to spin it in a Truth Social post completely divorced from reality. (He is very mentally unwell.)
To describe this as a stream of lies doesn’t even begin to capture the scale of the manipulation going on. The video footage, which was reviewed by city officials, clearly shows the woman backing up to avoid the officer before driving away. ICE agents had absolutely nothing to defend themselves from.
Trump’s framing of murderers as heroes and the victim and innocent bystanders as violent radicals is textbook propaganda.
What transpired here appears to be actionable criminal homicide, according to Glenn.
“That does not look like a justified use of deadly force,” he said.
Legally, there’s the possibility of both a federal criminal investigation and prosecution, and a state investigation and prosecution.
“I don’t think any of us are foolish enough to believe that Kash Patel’s FBI will conduct a legitimate full, fair investigation of this incident. If it did happen, Donald Trump would simply pardon him because in Donald Trump’s book, he’s already a hero based on that statement that Trump issued,” Glenn said.
If the state brings charges, the Federal Officer will probably try to get the case moved to Federal court where he would try to make the argument for “qualified immunity,” that he should be immune from prosecution as a Federal officer engaged in the “official duties” of the office. I don’t know of any office where the “official duties” include murder.
It’s likely his argument will fail, and federal prosecutors will decline to bring federal charges. See earlier: Kash Patel. Nevermind Pam Bondi, who’s even less likely to acknowledge anything happened at all, let alone bring charges.
“If this person ultimately is tried on those charges in federal court, well then the victim will have her day - her family - because she didn’t survive the incident, will have their day in court and hopefully justice will be done based on the evidence and the law.”
