I'm calling on you to publicly oppose any legislation that criminalizes people for using bathrooms that match their gender identity. No one should risk jail time for using the bathroom.
Laws like Idaho's House Bill 752 threaten transgender people with up to one year in jail for a first offense and up to five years in prison for a second conviction within five years. As advocate Nikson Mathews put it, the law creates an impossible choice: "Do I feel like going to jail, or do I feel like being attacked?" That's not a choice anyone should have to make in a free society.
Even law enforcement opposes these measures. The Idaho Fraternal Order of Police, the Idaho Chiefs of Police Association, and the Idaho Sheriff's Association all raised concerns about enforcement. Officers shouldn't be put in the position of determining someone's "biological sex" or judging whether exceptions apply. These laws criminalize presence, not conduct, and that's fundamentally unjust.
I expect you to stand up against this cruelty and fight for the dignity and safety of all your constituents.
