An open letter to the U.S. Congress

Congress Must Confront Trump’s Constitutional Violations

21 so far! Help us get to 25 signers!

Since President Trump returned to office, his administration has frequently tested—and in some instances, crossed—the constitutional limits that protect our democracy. The attempt to suspend habeas corpus without congressional approval was not only aggressive but also unconstitutional. The Supreme Court, including Justice Amy Coney Barrett, emphasized that only Congress has the authority to suspend this fundamental right (Vanity Fair, 2025). The effort to end birthright citizenship through executive order was yet another direct violation of the Constitution. The 14th Amendment is explicit, and multiple federal courts swiftly ruled that the administration’s actions violated it. Furthermore, in the case of deporting Venezuelan migrants under the Alien Enemies Act, a federal judge found probable cause to hold the administration in contempt for disregarding due process orders (J.G.G. v. Trump). These issues should not be seen as partisan; they are constitutional matters. Americans from across the political spectrum expect their government to operate within the rule of law. I urge you to act decisively, uphold the Constitution, and ensure that no administration—whether Republican or Democrat—is allowed to operate above it.
