An open letter to the U.S. House of Representatives

Defend congressional authority over federal grants from executive overreach

President Trump's attempt to temporarily freeze federal grant payments is a concerning overreach of executive power that undermines the constitutional system of checks and balances. As stated by Georgetown law professor Josh Chafetz, Congress alone has the authority to control federal spending through its "power of the purse." Even a temporary suspension of congressionally approved funding by the president violates the Impoundment Control Act and represents a threat to the separation of powers. If allowed to stand, this action could enable the president to act as an unchecked monarch in defiance of Congress's constitutional role. To preserve our democratic system of governance, the administration must respect the legislative branch's exclusive appropriations power and refrain from unilaterally freezing or impounding funds against the will of Congress. The court's preliminary injunction blocking the funding freeze was a necessary step to uphold the rule of law and prevent further erosion of congressional authority over the nation's finances.
