The executive order dismantling the Civil Rights Act of 1964 and revoking disparate impact liability represents a disturbing setback for civil rights in America. Disparate impact is a crucial legal tool for addressing systemic discrimination, even when policies appear neutral on their face. Without it, discriminatory practices that disproportionately harm marginalized groups will be exceedingly difficult to challenge. This order signals an intent to deprioritize and undermine enforcement of landmark civil rights laws across housing, employment, lending, and other areas. It poses a grave threat to hard-won rights and equity. We cannot allow this rollback of foundational protections that numerous communities have fought for over decades. Decisive action is needed to safeguard and uphold the Civil Rights Act to ensure all Americans have equal opportunity and recourse against discrimination.
