An open letter to the U.S. Congress

FDA Is Searching for 'Unknown Safety Concerns' in a Pill Approved Since 2000

I am writing as your constituent regarding the Food and Drug Administration’s (FDA) ongoing re-examination of mifepristone and to demand strict congressional oversight before any administrative action is taken. Approved by the FDA in 2000, mifepristone carries a quarter-century safety record, with serious adverse reactions occurring in fewer than 0.5% of patients under established labeling. Despite this, Health and Human Services Secretary Robert F. Kennedy Jr. directed the agency to re-evaluate the medication. In an October 7, 2026 court filing in Louisiana v. FDA, the agency revealed it is executing a "statistical data mining method" (a TreeScan analysis) across its Sentinel database to hunt for "unknown safety concerns," with study results expected by mid-December 2026 and a final report due by March 2027.  Despite the far-reaching implications for public health and federal drug regulation, FDA and HHS leadership have failed to provide basic administrative transparency: - The agency has not publicly identified who is leading the review following Commissioner Marty Makary’s resignation. - The agency has not committed to publishing its observational study protocol for independent peer review. - The agency has refused to guarantee a formal public comment period before implementing potential alterations to the drug's Risk Evaluation and Mitigation Strategies (REMS) program. When the FDA re-evaluates settled, 26-year-old drug safety determinations under political pressure, it destabilizes the entire statutory framework that drug manufacturers, physicians, and patients rely on. Congress must ensure that empirical evidence, procedural transparency, and established administrative law govern any regulatory action. I urge you to exercise your Article I oversight authority by demanding the following concrete actions: 1. Mandate Protocol & Leadership Transparency: Require the FDA to publish its complete study protocol and publicly identify the review leads before raw results are finalized in mid-December 2026.  2. Demand Full-Floor Accountability: Condition any floor confirmation vote on Dr. Heidi Overton committing on the record that the FDA will not alter mifepristone's REMS or restrict telehealth access absent conclusive, peer-reviewed clinical trial evidence. 3. Guarantee Public Comment: Mandate that the FDA publish all underlying datasets and open a formal, 60-day public comment period under the Administrative Procedure Act before modifying the mifepristone REMS protocol. 4. Convene Oversight Hearings: Schedule joint oversight hearings before the House Energy & Commerce and Senate HELP Committees examining the integrity of FDA post-market reviews prior to the March 2027 final report.  The FDA has evaluated this medication for 26 years. Before the executive branch alters access to a proven, long-approved drug, Congress must force the agency to show its work.
