An open letter to the U.S. Congress

Stop Power Companies From Seizing Land for AI Data Centers

31 so far! Help us get to 50 signers!

Power companies are using eminent domain to strip private landowners of their property — not to serve the public, but to run transmission lines for AI data centers. That is not what the takings clause was designed for, and you need to act now to stop it with strict regulatory oversight of utility eminent domain authority. Data centers already consume more than 4% of the nation's total electricity, and with 1,500 more in development, this land grab is only going to accelerate. Seventy percent of Americans oppose data center construction in their communities, and they certainly didn't sign up to have their land seized so corporations can profit from the AI boom. States like Georgia and Pennsylvania are already seeing this happen. The Fifth Amendment requires takings to serve a genuine public use — powering a private company's servers does not meet that bar. Require utilities to prove that any transmission project serves a broad public need before they can invoke eminent domain. Cap their condemnation authority, mandate independent review, and impose real penalties for abuse. Landowners deserve protection, not a forced sale at whatever price a power company decides is "just."
