An open letter to the U.S. Congress

Require Supreme Court transparency on shadow docket rulings

16 so far! Help us get to 25 signers!

The Supreme Court's increasing use of the "shadow docket" to issue consequential decisions without explanation or transparency undermines public trust in our judiciary. The Shadow Docket Sunlight Act would require the Court to provide a written explanation and disclose how each justice voted on emergency matters decided through the shadow docket process. This crucial legislation would bring much-needed accountability and clarity to the highest court's deliberations on issues with profound impacts on American lives. Given the momentous rulings being issued without due process or reasoning, immediate passage of the Shadow Docket Sunlight Act is imperative to uphold judicial integrity and the people's faith in the rule of law. Decisions impacting core rights should not be shrouded in secrecy, especially from the institution meant to safeguard justice and democracy. The American public deserves full transparency into the Supreme Court's shadow docket operations.
