Ethics Loopholes #4: The Presidential Kinship Loophole in Foreign Deals

I am writing as your constituent to demand concrete legislative action to close an ethics loophole that compromises American national security: the complete absence of statutory conflict-of-interest and foreign disclosure rules for immediate family members of a sitting President. This is not a hypothetical concern. ProPublica reported that Umar Kremlev, a Russian oligarch with close ties to Vladimir Putin, paid hundreds of thousands of dollars to rent a private island and fund celebrations for Donald Trump Jr.'s wedding in the Bahamas. While President Trump asserted that his son paid the oligarch back, no evidence of repayment has been made public. Public integrity cannot stop at the doorstep of the Oval Office. On September 22, 2026, Republican Senator John Curtis sent a formal letter to Senate Judiciary Chairman Chuck Grassley and Ranking Member Dick Durbin calling for a bipartisan investigation into the use of presidential family relationships for private financial benefit, urging the committee to subpoena both Donald Trump Jr. and Hunter Biden. As Senator Curtis stated: "A toaster is a wedding gift. A private-island party paid for by a Putin-connected oligarch is something else. Republicans nearly wore out the subpoena machine investigating Hunter Biden's foreign relationships. We should not unplug it now." Ranking Member Durbin supported the request, noting that corruption at the highest levels must never be tolerated. The public should not have to accept one standard for a Republican president's family and another for a Democratic president's family—nor should oversight end when the White House changes hands. Under current law, while federal officials face strict gift restrictions, adult presidential children operate in a regulatory void: - Monetizing direct family proximity: Foreign entities and sovereign wealth funds can funnel hundreds of millions of dollars into private ventures owned by a president's children—from luxury gifts and international real estate to crypto ventures and defense contracting stakes—with zero requirement for public disclosure under federal ethics laws. - Bypassing the Foreign Emoluments Clause: Because the Constitution's Foreign Emoluments Clause strictly targets public officeholders, foreign governments and overseas oligarchs can easily bypass constitutional intent by bestowing gifts, luxury assets, and commercial deals directly upon immediate family members. - Weak foreign registration enforcement: The Foreign Agents Registration Act (FARA) exempts routine commercial arrangements, leaving a massive gap where family members can engage with foreign officials and state-backed entities without registering as foreign agents. Selling proximity to executive power is a textbook form of institutional corruption that damages America's credibility and invites foreign influence. I urge you to support Senator Curtis's call for a formal Senate Judiciary inquiry and introduce or co-sponsor bipartisan legislation to: 1. Mandate family foreign disclosure: Require the immediate family members (spouses and adult children) of a sitting President and Vice President to file regular, unredacted public disclosures of all foreign income, gifts, and business assets over $10,000. 2. Close the FARA kinship loophole: Amend the Foreign Agents Registration Act to eliminate commercial exemptions for immediate family members of the President when dealing with foreign governments, sovereign wealth funds, or state-owned enterprises. 3. Bar foreign sovereign deals: Prohibit immediate presidential family members from entering into new commercial contracts or equity partnerships with foreign state entities while their relative holds executive office. Equal justice and ethical government require holding powerful families accountable, regardless of political party. I look forward to hearing your specific plan to support this bipartisan inquiry and close the presidential kinship loophole.
