REPEATED VIOLATIONS OF FEDERAL COURT ORDERS REQUIRE CONGRESSIONAL OVERSIGHT
As your constituent, I urge Congress to initiate an immediate oversight investigation into reports that agencies represented by the Department of Justice in federal court repeatedly violated binding federal court orders in immigration cases and to publicly report its findings.
Respect for Article III courts is fundamental to the rule of law, and Congress has a constitutional responsibility to investigate credible evidence that executive agencies may be disregarding judicial rulings.
ARTICLE III REQUIRES COMPLIANCE WITH COURT ORDERS
Under Article III of the Constitution, the executive branch must comply with lawful federal court orders regardless of which party controls the government.
A FEDERAL JUDGE DOCUMENTED 52 VIOLATIONS
U.S. District Judge Michael Farbiarz emphasized the seriousness of these violations, writing:
“Judicial orders should never be violated. And they very rarely are, especially not by federal officials.”
In a review ordered by the court, 52 violations of federal court orders in roughly 10 weeks were identified in cases involving detainee transfers, including missed deadlines, delayed releases, and transfers after courts had prohibited them.
ANOTHER FEDERAL JUDGE WARNED OF CONTEMPT
Chief U.S. District Judge Patrick J. Schiltz reported repeated violations of immigration-related court orders and warned that continued noncompliance could lead to contempt proceedings. He wrote that “the court’s patience is at an end.”
Judge Schiltz further noted that he was unaware of another moment “in the history of the United States” when a federal court had to threaten contempt “again and again and again” to force the United States government to comply with court orders.
A federal judge also recently warned that the “well-deserved credibility once attached to that distinguished Office has been undeniably eroded.”
These findings concern violations of binding judicial orders, not policy disagreements.
DOJ MUST ENSURE COMPLIANCE WITH COURT ORDERS
Because the Department of Justice represents federal agencies in court, it must promptly inform courts of violations and take concrete steps to secure agency compliance with judicial orders. Repeated violations therefore raise concerns about both agency conduct and DOJ supervision of the cases it litigates.
CONGRESS MUST PROTECT THE AUTHORITY OF ARTICLE III COURTS
Repeated violations of court orders threaten the constitutional balance of powers and require Congressional oversight.
I urge Congress to:
(1) Direct the House and Senate Judiciary Committees to investigate these violations.
(2) Hold public hearings requiring sworn testimony from Department of Justice and immigration enforcement officials.
(3) Require a full accounting of violations of federal court orders, corrective actions taken, and a public report of the investigation’s findings.
If investigation confirms systemic defiance of judicial orders, such conduct may warrant Congressional consideration under the impeachment authority granted by Article II, Section 4 of the Constitution, which authorizes impeachment of civil officers for “high crimes and misdemeanors.”

Because these matters fall within the oversight jurisdiction of the House and Senate Judiciary Committees, I ask that this message be shared with the legislative staff responsible for Judiciary Committee oversight of the Department of Justice.
And I respectfully request that your office inform constituents what steps you will take to address these violations and protect the authority of Article III courts.
