Condemn Justice Roberts For Failing to Back Judge Xinis

I am appalled by Chief Justice Roberts’ granting of an administrative stay in the case of Kilmar Armando Abrego Garcia. Allowing a person who was removed from the country, apparently without due process, in what the government has admitted was an error is a travesty. That error should be corrected immediately. It is unconscionable that a person who was legally residing in the United States and who has not been found guilty of any crime is now sitting in a prison in El Salvador. It is beyond comprehension that our government claims to be incapable of undoing a mistake that is tearing apart a family and likely causing a presumably innocent person to fear for their safety — if not for their life. The government’s claim that the order by Judge Xinis is “district-court diplomacy” is completely disingenuous. The government made a mistake — and admits to it — the government should have immediately and urgently started working on correcting their mistake. The fact that a court order is required to do this should strike fear in the heart of every person residing in the US. By failing to vigorously uphold the order of Judge Xinis, Justice Roberts has further undermined the rule of law in the United States and the legitimacy of the Supreme Court. The full court should immediately act to correct this mistake and vigorously defend our basic rights and the rule of law.
