I am writing to express my strong support for House Bill 2951, which would establish critical consumer protections for automatic subscription renewals in Arizona. This legislation addresses a widespread problem that affects thousands of Arizona consumers who struggle to cancel unwanted subscriptions and face unexpected charges. The bill's requirements are straightforward and reasonable. Businesses would need to present renewal terms clearly before charging consumers, obtain affirmative consent, and provide notification 25 to 40 days before automatic renewals occur. Most importantly, HB 2951 mandates that cancellation mechanisms be as simple as the original sign-up process, including one-step cancellation links on websites and in electronic communications. These protections are necessary because current practices often trap consumers in subscriptions they no longer want or need. Companies frequently make signing up easy while burying cancellation procedures in confusing menus or requiring phone calls during limited business hours. This asymmetry costs Arizona families real money and creates frustration that erodes trust in legitimate businesses. The bill strikes an appropriate balance by exempting regulated entities under Titles 6, 20, and 40 that already have oversight mechanisms. It also limits automatic renewals to one year unless consumers provide express written consent for longer terms, preventing indefinite commitments without ongoing consumer approval. With 22 bipartisan co-sponsors including Representative Connolly and legislators from across Arizona, HB 2951 demonstrates broad recognition that these protections are needed. The enforcement provisions through the Attorney General and private right of action with refund requirements ensure accountability without creating unreasonable burdens on compliant businesses.
