I demand immediate action to end U.S. obstruction of the International Criminal Court and establish equal accountability for genocide, crimes against humanity, war crimes, and aggression.
House members must cosponsor H.Res. 1435 and press the House Foreign Affairs and Judiciary Committees to advance it.
Senators must introduce and cosponsor a Senate companion resolution calling for U.S. ratification of the Rome Statute and membership in the ICC.
Nonbinding resolutions are not enough. Both chambers must introduce and pass binding mirror legislation that:
• Repeals the American Servicemembers’ Protection Act, including its infamous “Hague Invasion Act” authority.
• Removes federal barriers preventing state, local, and federal officials from cooperating with lawful ICC investigations and warrants.
• Creates clear procedures for arresting and surrendering individuals wanted by the ICC.
• Ends and prohibits sanctions, threats, funding restrictions, or retaliation against ICC judges, prosecutors, staff, witnesses, human-rights organizations, and anyone assisting the Court.
• Prevents any administration from obstructing or intimidating the ICC.
• Rejects every carveout shielding U.S., Israeli, or other allied officials from impartial investigation and prosecution.
Members of Congress must also publicly support New York City Mayor Zohran Mamdani’s efforts to pursue every lawful avenue regarding the outstanding ICC warrant for Benjamin Netanyahu during his expected United Nations visit.
Congress must oppose threats, retaliation, or federal interference against New York officials for seeking accountability. Congress must establish an explicit legal pathway for enforcement before Netanyahu arrives.
The United States cannot invoke international law against its adversaries while attacking courts and granting protection when Israel, the United States, or another ally faces scrutiny. Palestinian lives are not exceptions. Neither are victims in Sudan, Afghanistan, Ukraine, the Democratic Republic of the Congo, or anywhere else.
Justice must apply equally, regardless of nationality, military power, or political alliance. Selective accountability is impunity.
Please state whether you will:
Cosponsor H.Res. 1435 or introduce its Senate companion;
Support binding mirror legislation;
Repeal the American Servicemembers’ Protection Act;
End U.S. sanctions and attacks against the ICC;
Defend Mayor Mamdani’s pursuit of every lawful accountability measure; and
Support unconditional U.S. accession to the Rome Statute.
Statements are not enough. Take binding legislative action.
