I am writing to formally request immediate congressional oversight regarding recent reports that senior White House adviser Stephen Miller is authoring executive orders, briefing Cabinet officials, and directing policy actions without clear authorization from President Donald J. Trump.
If accurate, these reports raise a serious constitutional concern. Executive authority in the United States is vested in an elected President, not in unelected advisers. The appearance or reality of policy being initiated, drafted, or operationalized outside the President’s direct approval undermines democratic accountability and the separation of powers.
At minimum, the situation creates reasonable doubt about who is exercising executive authority. At worst, it suggests the existence of a de facto governing structure operating without electoral mandate or constitutional legitimacy.
Congress has an obligation to clarify:
• Whether executive orders or policy directives are being drafted or advanced without the President’s explicit authorization
• Whether Cabinet officials are being briefed or directed by unelected staff acting beyond advisory capacity
• Whether established legal and constitutional chains of authority are being followed
This is not a partisan issue. Regardless of party or administration, the American public deserves transparency about who is governing and under what authority. Failure to address this promptly risks normalizing governance by proxy and eroding trust in constitutional institutions.
I urge you to use your oversight authority to investigate these reports, seek sworn testimony if necessary, and publicly clarify the facts. Silence or inaction on an issue of this magnitude is not acceptable.
