Protect the Peace: Oppose Any Invocation of the Insurrection Act in Minnesota

I am writing to urge you to publicly oppose and actively discourage any invocation of the Insurrection Act in response to events in Minnesota.
The Insurrection Act is a narrowly tailored, extraordinary authority intended only for circumstances in which a state is unable or unwilling to enforce the law or protect constitutional rights. That threshold has not been met. Minnesota’s civil authorities remain fully operational and have acted to maintain public safety while respecting constitutional protections for speech, assembly, and due process.
Invoking the Insurrection Act in this context would represent a serious overreach of executive power, undermining federalism and the long-standing principle that military force must not be used to supplant civilian governance. It is especially inappropriate where public unrest stems from credible allegations of brutality by federal agents themselves, which demand investigation and accountability—not militarization.
Beyond its legal defects, the President’s threat to invoke the Insurrection Act is unnecessary and reckless. Such threats risk creating fear, provoking instability, and escalating tensions nationwide, rather than restoring order. History makes clear that deploying or threatening military force against civilian populations during moments of crisis often deepens conflict and erodes public trust in democratic institutions.
The rule of law requires restraint when government power is under scrutiny. Minnesota’s response—calling for calm, protecting residents, and allowing lawful protest—demonstrates that civil authority remains intact. The appropriate federal role is to support de-escalation, transparency, and constitutional limits, not to inflame conditions through coercive threats.
