An open letter to the U.S. Congress

Trump's Attack on the International Criminal Court Disgraces America

306 so far! Help us get to 500 signers!

As your constituent, I urge you to condemn and reverse the Trump administration’s October 9 sanctions against the International Criminal Court (ICC). The United States should not use its financial power to cripple a court that prosecutes genocide, war crimes, and crimes against humanity. The sanctions threaten international justice and America’s reputation. Congress should press for their withdrawal and act to prevent lasting harm. CRIPPLING THE COURT COULD DENY VICTIMS JUSTICE The ICC pursues grave crimes when national courts are unwilling or unable to do so. It depends on banking, technology, and other services to investigate crimes and conduct trials. Cutting off those services could delay testimony, put evidence at risk, and leave victims and their families waiting longer for justice. Survivors of mass violence may have nowhere else to turn. The administration has sanctioned the court under Executive Order 14203 but temporarily permitted certain transactions needed to keep it operating. Unless those permissions are extended or the sanctions withdrawn, essential services could be disrupted after 180 days. Congress should act now to prevent that result. AMERICA CANNOT CHAMPION JUSTICE WHILE CRIPPLING A COURT THAT PROSECUTES ATROCITIES The United States cannot credibly insist that adversaries answer for war crimes while trying to disable a court that might investigate Americans or our allies. This double standard weakens our moral authority and gives abusive governments an excuse to evade scrutiny. It also strains relations with close allies that support the ICC. Eight allies, including Britain, France, Germany, and Japan, have defended the court against these sanctions. Cooperation with them is essential to American security and diplomacy. PROTECTING AMERICAN SOVEREIGNTY DOES NOT REQUIRE DISABLING THE COURT The United States has not joined the ICC, and disputes over its authority to investigate Americans deserve serious attention. But those objections can be pursued through diplomacy and legal means. They do not justify undermining the court’s work in cases involving atrocities elsewhere. A country confident in its commitment to justice should seek fair rules, not immunity from scrutiny. CONGRESS MUST CONDEMN THE SANCTIONS AND SECURE THEIR REVERSAL (1) PUBLICLY CONDEMN THE ACTION. Reject the court-wide sanctions and reaffirm American support for justice for victims of atrocities. (2) PRESS FOR REVERSAL. Urge the President to rescind the October 9 designation and lift sanctions on judges and prosecutors imposed for their official work, before temporary licenses expire. (3) INTRODUCE LEGISLATION. Restrict the use of Executive Order 14203 and related sanctions powers to disrupt the ICC’s essential operations, while preserving legitimate U.S. legal objections. (4) HOLD OVERSIGHT HEARINGS. Examine the sanctions’ legal basis, effects on investigations and victims, and damage to U.S. alliances and credibility. Thank you.
