We, the the people of the United States of America and citizens of the world call on the United States Congress to stand against apartheid, occupation and genocide by upholding and enforcing the following laws -
1. The State Department Leahy Law - the Foreign Assistance Act of 1961, 22 U.S.C. 2378d. Israel has committed gross violations of human rights consistently with the full knowledge and support of the United States United Kingdom, Canada, and other governments full knowledge.
The U.S. government considers torture, extrajudicial killing, enforced disappearance, and rape under color of law as GVHRs when implementing the Leahy law. Incidents are examined on a fact-specific basis.
2. Department of Defense Leahy Law - Section 362 of Title 10 of the U.S. Code requires that DoD-appropriated funds may not be used for any training, equipment, or other assistance for a foreign security force unit if the Secretary of Defense has credible information that such unit has committed gross violations of human rights.
3. The US Foreign Assistance Act of which section 620 I reads" prohibits the United States from providing security assistance or arms sales to any country when the President is made aware that the country’s government “prohibits or otherwise restricts, directly or indirectly, the transport or delivery of United States humanitarian assistance.”
4. The Arms Export Act - which limits the use of US weapons to internal security use and legitimate self-defense. It is clear that the US-provided weapons are not being used in self-defense but instead in collective punishment of the Palestinian people, enforcement of apartheid, and occupation by the occupying power as defined by the United Nations -Israel is the occupying power of Palestine.
5. The Biden Administration's own Conventional Arms Transfer (CAT) policy prohibits arms being given to a country when they are more likely than not to result in genocide, crimes against humanity, breaches of the Geneva Conventions, and violence against children.
As is well established over 13,000 children and counting have been murdered with US-provided weapons by Israel and Israeli settlers in Gaza as well as occupied territories such as the West Bank as reported by UNICEF in March of 2024.
6. National Security Memorandum/ NSM-20 - which prohibits the transfer of weapons to a country that violated assurances that it would not commit violations of humanitarian law or block the United States of America's humanitarian aid. Israel has violated all assurances and its documented to such an extent that now the International Criminal Court - The Hague is adjudicating a case brought by Nicaragua against Israel for violating the Geneva Conventions.
The United States Congress should not make exceptions for any country that engages in violations of our own established laws nor international laws.
