An open letter to the U.S. Congress

Stop ICE's Attempt to Void State Oversight of Detention Centers

You need to act immediately to stop ICE from unilaterally nullifying state law. One day after a federal judge ordered an ICE detention center opened to state health inspectors, ICE posted new contract terms explicitly stating that state laws "shall not apply" to four detention facilities. That is not a coincidence. That is a deliberate end-run around a court order, and it cannot go unanswered. No federal agency gets to rewrite a contract and declare itself exempt from state health and safety oversight. The Supremacy Clause does not give ICE the power to override state law through procurement language, and no president has the authority to place federal detention centers beyond the reach of basic inspection. People are being held in these facilities. The public has a right to know those conditions meet minimum health and safety standards. Demand a full congressional investigation into these contract terms, and push for legislation that explicitly affirms states' authority to inspect all detention facilities operating within their borders.
