nobody has a right to pollute or over-pump water

If a property owner is the true owner of the property, that necessarily establishes a private attainable right to sue polluters and water-pumpers who have infringed on the soil, water table, or air of the property. If there is no attainable private right to sue, the only logical other scenario is that the property, together with its air water and soil, is owned by the public as a whole and the government has the responsibility to sue when the soil, water table, or air are unwholesomely disturbed.
