Transferring oversight of special education programs to agencies outside of the Department of Education raises serious legal concerns. The Department's Office of Special Education and Rehabilitative Services has the dedicated expertise to administer the Individuals with Disabilities Education Act (IDEA) and ensure students with disabilities receive the free, appropriate education they are legally entitled to. Robert Kennedy Jr. is not an expert or scientist. Moving responsibility for IDEA would disrupt essential services for millions of students with special needs. Do not close the Department of Education. Do not put Kennedy in charge of IDEA.
