I am writing to urge you to take legislative action to reform the presidential pardon process and prevent the abuse of clemency power to benefit campaign donors and white collar criminals.
The pattern of pardons issued during the Trump administration reveals a troubling connection between campaign finance and clemency. Unlike previous administrations that focused pardons on nonviolent drug offenders serving lengthy sentences, these pardons disproportionately benefited wealthy donors and those convicted of campaign finance violations.
Consider the February 2020 pardons issued immediately after impeachment. Paul Pogue received a pardon after pleading guilty to underpaying taxes by more than $400,000, while his son and daughter-in-law donated $238,541 to Trump Victory between August and October 2019. Michael Milken, the junk bond king worth billions, received clemency after GOP megadonor Sheldon Adelson advocated on his behalf.
Former Illinois Governor Rod Blagojevich had his sentence commuted despite being convicted of attempting to sell Barack Obama’s Senate seat and trying to shake down a children’s hospital CEO for $25,000 in campaign contributions. Even Trump’s first pardon of Joseph Arpaio involved someone whom Judge Murray Snow found committed contempt based on the notoriety and campaign donations he received for immigration enforcement activity.
This pattern undermines public trust in our justice system and creates a two-tiered system where wealthy donors receive preferential treatment. I urge you to support legislation that would require transparency in the pardon process, mandate review by the Office of the Pardon Attorney, and establish clear ethical guidelines preventing pardons for campaign contributors. Our democracy depends on equal justice under law, not clemency for sale.
