Pass SB 447: Restoring Victims' Rights for Restorative Damages

I am a constituent from your district contacting you to urge your vote to pass SB 447: Restoring victim’s rights and stopping wrongdoers benefitting from court backlogs and delay until victims die. California is one of only five states that allow a victim’s human suffering damages to die with them.   As a result, current law creates a perverse incentive for defendants to delay cases and harass ill plaintiffs in the hopes that the plaintiff will die before trial, allowing the wrongdoer to avoid paying any restitution for the human suffering they caused.   SB 447 would correct this injustice.   To ensure deterrence and restore equity to plaintiffs unable to survive through trial, SB 447 would update California law to allow plaintiffs to preserve their human suffering damages, even if they pass away before trial or resolution of their case. As a voting member of your constituency, I urge you please to vote to pass SB 447 to protect victims and their families from these corporate abuses. Thank you for your time and consideration.
