Abolish ICE Following Unconstitutional Home Entry Policy

I am writing to urge you to support the abolition of Immigration and Customs Enforcement following revelations of a secret policy authorizing unconstitutional home invasions. Two whistleblowers represented by WhistleblowerAid.org disclosed to the Senate on January 21, 2026, evidence that Acting ICE Director Todd Lyons issued a memo on May 12, 2025, authorizing agents to forcibly enter homes without consent or judicial warrants. This memo instructs agents to use Form I-205, an administrative warrant of removal, as justification for home entry despite this form having no legal authority to authorize such entry. This policy directly violates the Fourth Amendment. The Supreme Court has described warrantless physical entry of homes as "the chief evil against which the wording of the Fourth Amendment is directed." A federal district court judge in Minnesota recently ruled that ICE violated the Fourth Amendment when it forcibly entered a home without consent or a judicial warrant. No court has ever found ICE agents have legal authority to enter homes without judicial warrants. The secretive rollout of this policy is particularly troubling. The memo was not widely distributed despite being labeled "All-Hands." Some agents received only verbal briefings, others were allowed to view but not retain copies, and agents who objected faced termination threats. This secrecy suggests ICE leadership knows the policy cannot withstand legal or public scrutiny. ICE is training new recruits with no prior law enforcement experience to disregard constitutional protections. Recent reports document ICE officers breaking into homes of U.S. citizens without judicial warrants. This agency has demonstrated it cannot be trusted to respect fundamental constitutional rights. The evidence is clear that ICE operates outside constitutional boundaries and resists accountability. I urge you to support legislation to abolish ICE and replace it with an immigration enforcement system that respects the Constitution and human dignity.
