I am writing to demand that you speak out and take action against Donald Trump’s continued threats and attempts to illegally deploy the National Guard into U.S. cities. His actions are not only reckless but unlawful, and history shows us clearly why such abuses must be stopped.
Trump is violating, or threatening to violate, the following:
• The Posse Comitatus Act of 1878 (18 U.S.C. § 1385): This law prohibits the use of the U.S. military to enforce domestic laws without explicit authorization from Congress or the Constitution. Trump’s attempts to send armed forces into cities that have not requested them directly violates this safeguard.
• The Insurrection Act (10 U.S.C. §§ 251–255): This act allows a president to deploy troops only in extremely limited circumstances, such as when states are unable to protect constitutional rights. Trump has offered no legal justification to invoke this authority—his threats are purely political.
• The Constitution, Article II and the Tenth Amendment: The president is not granted unlimited power over the states. By attempting to override governors and mayors in deploying the Guard, Trump is violating the principle of state sovereignty.
History makes clear the dangers of Trump’s actions:
• In 1957, President Eisenhower invoked the Insurrection Act to enforce Brown v. Board of Education and protect Black students integrating Little Rock schools. This was done to uphold constitutional rights when a state government refused to comply with federal law. Trump’s situation bears no resemblance—he is not enforcing rights, he is threatening political enemies.
• In 1992, President George H.W. Bush deployed troops to Los Angeles only after California’s governor formally requested federal help to restore order during the Rodney King riots. Trump, by contrast, is threatening to override governors against their will—an abuse with no legal precedent.
• Courts have consistently warned against unchecked presidential authority in domestic deployment of troops. Allowing Trump to normalize this behavior would dangerously expand executive power beyond constitutional limits.
Trump is deliberately inflaming tensions between red and blue states, pushing our nation toward chaos, and attempting to turn the military into his personal police force. This is not lawful governance—it is authoritarianism.
Congress must act now. I urge you to publicly condemn these abuses, investigate these unlawful threats, and reaffirm that no president can use the military against the American people for personal or political purposes.
We are counting on you to defend the Constitution before it is too late.
