As a constituent and a voter in your district, I am writing to express my grave concern regarding the ongoing legal and administrative crisis at the Department of Health and Human Services. Under the leadership of Secretary Robert F. Kennedy Jr., the Department has moved beyond policy disagreement into a pattern of documented lawlessness that requires immediate House intervention.
The situation has escalated from a policy dispute to a legal crisis. While the Secretary claims to be "reorganizing" the Department, recent events prove he is operating in willful defiance of federal law:
- Judicial Injunction (March 16, 2026): As you may know, the U.S. District Court recently halted the Secretary’s attempt to dismantle the national immunization schedule, citing likely violations of the Administrative Procedure Act. The courts have effectively confirmed that the Secretary is bypassing the legal notice and comment periods required by Congress.
- Impact on our State: We are seeing the human cost of this lawlessness. With over 1,500 measles cases nationwide—and numbers rising in our state—the paralysis at the CDC is now a direct threat to the families in your district, particularly those in underserved communities who rely on stable public health infrastructure.
- Illegal Personnel Actions: The summary firing of the ACIP members and the purge of nearly 5,000 career scientists are not merely efficiency moves; they appear to be violations of civil service protections and federal advisory committee statutes.
- Illegal Impoundment of Funds: The Secretary’s recent freeze on billions in NIH research grants constitutes a theft of congressionally appropriated money. By unilaterally halting funds already authorized by Congress, the Secretary is in direct violation of the Impoundment Control Act, usurping the Power of the Purse that the Constitution explicitly grants to you and your colleagues in the House.
I urge you to use your platform on the House floor to:
1. Introduce or co-sponsor Articles of Impeachment against Secretary Kennedy for gross dereliction of duty and repeated violations of the Administrative Procedure Act.
2. Demand an emergency field hearing to investigate the impact of these HHS "reorganizations" on minority health outcomes and community safety.
The Secretary is not just changing policy; he is breaking the guardrails of our democracy. We need your leadership to ensure that no cabinet official is above the law.
