I am writing today as your constituent to urge you to take immediate action to end the ongoing national emergencies that are being used to justify harmful and potentially unconstitutional executive actions—specifically those invoked by former President Trump and still active under federal law.
The Alien Enemies Act, a law from 1798, is currently being invoked through a declared “emergency” that has allowed for mass detentions and removals without due process. This has culminated in serious violations of constitutional rights, as highlighted in the recent case J.G.G. v. Trump—where the government actively defied a federal court’s restraining order and transferred detainees into a Salvadoran mega-prison.
These emergency declarations are being used not for national security, but as cover for authoritarian policy by executive fiat. The continued status of these so-called “national emergencies”—long after any legitimate threat has passed—must be addressed by Congress.
I urge you to:
1. Review and rescind outdated or abused national emergency declarations, particularly those not reaffirmed by Congress under the National Emergencies Act.
2. Support legislation to reform or repeal the Alien Enemies Act, or at a minimum, impose serious limits on its application in modern times.
3. Demand accountability for any executive agencies or officials who violate judicial orders under the guise of emergency authority.
It’s time for Congress to reassert its role and end the abuse of “emergency” powers that were never meant to become permanent loopholes in our democracy.
