I urge you to pass the Fourth Amendment Is Not For Sale Act. Fifty years ago, Watergate revealed a president using IRS audits against his "enemies," and the Church Committee exposed years of spying on Americans, Congress passed the Privacy Act of 1974, the Tax Reform Act of 1976, and FISA in 1978. The law has not kept up and consequently our data and life stories are freely shared and sold between and among agencies and Big Tech data brokers. These powers are dangerous in anyone's hands, and no administration of either party should hold them without limits. Require a court order before any agency gets ongoing bulk access to another agency's records. Define a “record” as anything generated by algorithm and AI. Create an independent privacy watchdog in the legislative branch with power to audit, investigate, and publicly report on how agencies acquire, share, and use our data. Pass comprehensive consumer privacy legislation with data-minimization rules so companies can't stockpile our data to sell to agencies later. Require a warrant for searches of Americans' communications in any renewal of FISA Section 702. The Privacy Act was written for filing cabinets and early mainframes, and it is failing. Congress built the guardrails a long time ago in the prior century. Please rebuild the guardrails for the century we actually live in.
