An open letter to the U.S. Congress

The Illegitimate Court Counteraction Act

The Illegitimate Court Counteraction Act represents a concerning overreach that threatens to undermine principles of international law and human rights. This legislation seeks to impose harsh sanctions on the International Criminal Court and any individuals associated with efforts to investigate or prosecute alleged crimes committed by United States officials or personnel. Such actions would seriously impair the ability of the ICC to pursue accountability for atrocities and human rights violations. While the United States is not a party to the Rome Statute, the court plays a vital role in providing justice for victims when national legal systems are unwilling or unable to do so. Obstructing its work through economic penalties and travel bans sets a dangerous precedent of impunity. Rather than resorting to punitive measures against an institution dedicated to upholding international humanitarian law, the United States should engage constructively with the global community. Protecting American interests does not necessitate shielding potential perpetrators from legitimate judicial scrutiny. True American values are rooted in a commitment to human rights and the rule of law. This bill undermines those ideals and should not be enacted.
