Contempt Vote for Exercising the 5th Amendment Is an Abuse of Power

As your constituent, I am writing to express my outrage over the Senate Homeland Security and Governmental Affairs Committee's 8-5 party-line vote to hold Dr. Anthony Fauci in contempt of Congress, as well as the decision to bypass a full Senate vote entirely. Dr. Fauci invoked his Fifth Amendment right during his July 29 hearing. Rather than bring this contempt referral to the full Senate—where it lacks the 60 votes required to pass—the committee leadership delivered the referral directly to the Department of Justice. Converting congressional oversight into a platform for selective prosecution, then routing around the full Senate to pursue it, sets a dangerous precedent for any future witness appearing before a congressional committee. - Exercising a Constitutional Right Is Not Contempt: Dr. Fauci's invocation of the Fifth Amendment, on the advice of counsel, was a standard legal protection, not an act of defiance. When a witness faces a committee whose leadership has publicly pre-judged their guilt, that witness has every right to invoke constitutional protections against self-incrimination. Punishing a citizen criminally for exercising a constitutional right is not oversight—it is retaliation dressed up as procedure. - A Symbolic Referral Is Not Sound Governance: Legal experts and committee members alike have noted that this referral is unlikely to stand up in court or be pursued effectively by the Department of Justice. Senator Richard Blumenthal noted it is "very unlikely ever to be pursued" and will "almost certainly never" hold up legally. When a committee pushes forward with a referral its own advocates know will fail legally, its only remaining function is political spectacle. - Constituents Expect Legislation, Not Personal Feuds: Congressional oversight exists to inform legislation and hold executive power accountable—not to serve as a platform for personal or political grievances against individual witnesses. Celebrating the criminal referral of a career public servant over the exercise of basic constitutional rights is not a serious act of governance. I urge you to publicly condemn this vote and referral, call on the Department of Justice to decline to pursue this case, and demand that committee leadership return to the real work of legislative oversight. Reasonable citizens across the nation are watching how our representatives handle this, and we will remember it. You are wasting the People's time and money with this vindictive prosecution.
