Protecting State Authority: Response to April 28 Federal Executive Order

I am writing regarding President Trump’s April 28, 2025 Executive Order on law enforcement, which contains provisions that may significantly impact our state’s sovereignty and authority over law enforcement matters.
This Executive Order directs the Attorney General to review and potentially modify consent decrees involving state law enforcement (Section 3b) and threatens federal prosecution of state officials who implement certain policies (Section 5). It also appears to challenge state-level diversity and inclusion initiatives in law enforcement.
As our governor, you have sworn to uphold both the U.S. Constitution and our state constitution. I believe this Executive Order raises serious federalism concerns that may require a coordinated state response.
I respectfully urge you to:
1. Work with our state Attorney General to assess the legality of this order and its impact on our state.
2. Coordinate with other governors facing similar concerns to develop a unified response if necessary.
3. Consider what executive actions might be necessary to protect state prerogatives and state employees.
4. Communicate clearly with the public about how our state will respond.
Governors have historically been crucial defenders of state authority against federal overreach, regardless of party affiliation. I hope you will take this responsibility seriously in the face of this concerning Executive Order.
