The Iraq War is long over, yet the law authorizing it remains. The fact that the 2002 Iraq AUMF is still in place today, more than a decade after the war was declared over, stands in direct contrast to Congress’s unique power and responsibility to decide whether and when the United States chooses war. We have seen presidents on both sides of the aisle use the 2002 AUMF to justify attacks that Congress never even contemplated, let alone authorized. In recent years, the House has voted many times to repeal this authorization. The Senate has done the same, and President Biden has signaled his support. It is time to end this war once and for all formally. Why has the 2002 Iraq AUMF not yet been repealed after both Houses of Congress and the President have indicated their intent to do so? I strongly urge you to repeal this terrible violation of the Constitution’s explicit provision that the power to make war rests solely with the people through their elected representatives, not at the whim of an executive who may or not be the best and the brightest.
