Oppose HSB242

I am writing to express my strong opposition to House Study Bill 242, known as the Iowa Civil Rights Removal Act. This legislation proposes the removal of gender identity as a protected characteristic from the Iowa Civil Rights Act, effectively stripping transgender Iowans of essential protections against discrimination in housing, education, employment, public accommodations, and credit practices.
If enacted, HSB242 would:
Remove Civil Rights Protections: By eliminating gender identity from the Iowa Civil Rights Act, transgender individuals would lose legal safeguards against discrimination, making it permissible to deny them housing, employment, and services based solely on their identity.
Restrict Access to Accurate Identification: The bill mandates that birth certificates reflect an individual's sex assigned at birth, preventing transgender Iowans from obtaining identification documents that align with their gender identity. This can lead to challenges in everyday situations where identification is required.
Redefine Legal Terms: HSB242 seeks to redefine "sex" in state law as strictly male or female, as observed at birth. This narrow definition fails to acknowledge the existence and experiences of transgender and non-binary individuals, effectively erasing them from legal recognition.
The removal of rights for some will begin the removal of rights for many more. This bill sets a dangerous precedent that undermines the civil liberties of all Iowans. We must ensure our state is on the right side of history—and this is not it. HSB242 does not protect women; rather, it makes our communities less safe by encouraging discrimination and exclusion rather than fostering fairness and equality.
Transgender Iowans are our friends, neighbors, family members, and coworkers. They deserve the same fundamental rights, dignity, and respect as anyone else. Enacting this legislation would not improve the lives of Iowans; instead, it would inflict harm on a vulnerable population, undermining the principles of equality and justice that our state upholds.
I urge you to consider the detrimental impact this bill would have on the lives of transgender individuals and to vote against HSB242. Let us work together to foster an inclusive Iowa that respects and protects the rights of all its residents.
Thank you for your attention to this critical matter.
